ServersNow provides cloud hosting and network services, including but not limited to VPS hosting, BGP services, IPv4 tunneling, and network consulting. The specific features and limitations of each service are described on our website and in the service documentation provided to you upon purchase.

3. Account Registration and Security

To use our Services, you may need to create an account. You are responsible for:

• Providing accurate and complete information when creating your account
• Maintaining the security and confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or if we suspect unauthorized or fraudulent use.

4. Payment Terms

4.1 Pricing and Billing

Prices for our Services are listed on our website and may be subject to change. We bill in advance for our Services on a monthly, quarterly, or annual basis, depending on the billing cycle you select. All fees are non-refundable except as expressly provided in these Terms.

4.2 Payment Methods

We accept various payment methods as indicated on our website. By providing payment information, you represent that you are authorized to use the payment method and agree to pay all charges incurred.

4.3 Late Payments

If payment is not received by the due date, we may suspend or terminate your Services. A late fee may be applied to overdue accounts.

5. Service Level Agreement (SLA)

Our Service Level Agreement outlines our commitments regarding service availability, performance, and support response times. The SLA is available at ServersNow SLA and is incorporated into these Terms by reference.

6. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not use our Services to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Distribute malware, viruses, or other malicious code
• Engage in activities that disrupt or interfere with our Services or networks
• Conduct unauthorized scanning, penetration testing, or vulnerability assessments
• Send unsolicited commercial communications (spam)
• Host content that is illegal, harmful, threatening, defamatory, or otherwise objectionable

6.1 Prohibited Content and Activities

Without limiting the generality of the foregoing, the following types of content and activities are specifically prohibited:

• Warez and Unauthorized Software: Storing, distributing, or linking to warez, cracked software, pirated software, unauthorized license keys, key generators, or any other unauthorized or illegally obtained software.
• Illegal File Sharing: Operating file sharing services, BitTorrent trackers, or other systems primarily used for the unauthorized distribution of copyrighted material.
• Illegal Pornographic Material: Hosting, distributing, or storing any pornographic content that is illegal under applicable laws, including but not limited to child sexual abuse material, non-consensual intimate imagery, or any content that depicts or promotes sexual exploitation.
• Copyright Infringement: Hosting or distributing content that infringes upon the intellectual property rights of others, including unauthorized copies of music, movies, books, or other copyrighted works.
• Hacking Tools: Distributing tools designed primarily for unauthorized access to computer systems, unless used for legitimate security research with proper authorization.
• Dark Web Services: Operating services intended to facilitate illegal activities, including darknet marketplaces for illegal goods or services.

6.2 Enforcement and Reporting

ServersNow reserves the right to:

• Investigate potential violations of these Terms
• Remove or disable access to any content that violates these Terms
• Suspend or terminate Services without prior notice for users who violate these Terms
• Report violations to law enforcement authorities when required by law

We reserve the right to suspend or terminate Services for users who violate our Acceptable Use Policy.

7. Content and Data

7.1 Your Content

You retain all rights to any content you upload, transmit, or store using our Services. You grant us a limited license to use, store, and copy such content solely as necessary to provide the Services to you.

7.2 Backups

While we may perform regular backups of our systems, you are responsible for maintaining your own backups of your data. We do not guarantee the recovery of lost data.

8. Intellectual Property

All intellectual property rights in our Services, including but not limited to software, designs, logos, and documentation, are owned by ServersNow or its licensors. Nothing in these Terms grants you any right, title, or interest in such intellectual property.

9. Limitation of Liability

To the maximum extent permitted by law, ServersNow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with these Terms or your use of the Services.

Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount paid by you to ServersNow for the Services during the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless ServersNow and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of another.

11. Term and Termination

These Terms will remain in effect until terminated by either you or ServersNow. You may terminate these Terms by discontinuing use of our Services and closing your account. We may terminate or suspend your access to the Services at any time for any reason, including but not limited to your violation of these Terms.

Upon termination, your right to use the Services will immediately cease, and we may delete your account and all associated data.

12. Changes to Terms

We may modify these Terms at any time by posting the revised Terms on our website. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and SLA, constitute the entire agreement between you and ServersNow regarding the Services and supersede all prior agreements and understandings.
